Defense Attorney Said Jerni Warner’s Medical Issues are Worse and Haven’t Been Addressed

Jerni Warner was transferred to the Henry County Jail one month ago from the Mary Davis Detention Center.  Ms. Warner remains in custody on a $1 Million dollar bond.  After months of motion hearings, the Defense submitted a Motion and withdrew the Motion regarding medical care for Ms. Warner at the first Jury Pre-Trial.  The State said, for the record, they object to the Motion as it is written now.  Judge Cosby said he hasn’t seen the motion and the contents of the Motion were not disclosed to the public because Attorney Sullivan said he intends to draft a new motion with attachments.  Defense Attorney Sullivan said “nothing has been addressed” regarding Jerni Warner’s medical care.  He said her medical issues are getting worse.  Attorney Sullivan said “Her health comes first” and he wanted to “enlighten the court of the issues”.  He said he will continue to address the issues.  A 15 minute Motion Hearing is scheduled for 11 AM with the pre-trial following after.  The Jury Pre-Trial is continued to October 20, 2022, at 11 AM.  In August, Ms. Warner requested a transfer to the Henry County Jail for better access to medical care that Mary Davis can’t accommodate.

Warner is charged with two counts of Aggravated DUI/Death (Class 2 Felony) for the deaths of Garry and Leah Kelly on September 5, 2021.  Warner is accused of crossing the center line with her vehicle, striking head-on the motorcycle the Kelly’s were driving, causing the deaths of Garry and Leah Kelly.  An SUV, occupying two adults and five children, traveling behind the motorcycle was also allegedly struck by Ms. Warner’s car.  Lab tests were positive for alcohol and cocaine.
